Title Examination

Title Examinations

A title examination is a comprehensive review of a property's ownership history, liens, encumbrances, and other potential issues that could affect the title. Title examinations are conducted by our experienced title examiner who reviews public records, including deeds, mortgages, judgments, and other documents, to ensure that the property's title is clear and marketable.

If any issues are discovered during the examination, we will work with all parties involved in the transaction to resolve them before closing. A clear title is essential to any real estate transaction, and title examinations provide peace of mind to buyers, sellers, and lenders that the property's title is free from defects.

Title Commitment

Title Commitments

A title commitment is a preliminary report that outlines the conditions that must be met before a closing can occur and a title policy can be issued. The title commitment includes information on the property's ownership history, liens, encumbrances, and other potential issues that could affect the title. It also outlines any requirements that must be met before the title can be transferred or a mortgage can be issued. The title commitment provides the buyer and the lender with the opportunity to address any issues before closing and to ensure that the property's title is clear and marketable.

We work with all parties involved in the transaction to resolve any issues and ensure a smooth closing process.

Owners & Encumbrances Reports

An Owner and Encumbrance (O&E) report is a summary of the public records associated with a particular property, including the current owner, any liens, or other encumbrances that affect the property's title. O&E reports provide an overview of the property's ownership history and any potential issues that could affect the title.

Abstracting & Title Research

Abstracting is the process of reviewing public records related to a specific property to create an abstract, which is a compilation of the history of the property's ownership and title. Title research involves examining the abstract, public records, and other documents related to the property to identify any issues that could affect the title, such as liens, encumbrances, or ownership disputes.

We work to ensure that the property's title is clear and marketable and to identify any potential issues that need to be resolved before closing. Abstracting and title research are critical components of any real estate transaction, as they provide important information that helps buyers, sellers, and lenders make informed decisions and ensure a successful closing process.

1031

1031 Tax-Deferred Exchanges

A 1031 tax-deferred exchange is a process in which an investor can sell a property and use the proceeds to acquire another property without paying taxes on the capital gains from the sale. We provide services to facilitate a 1031 exchange, including escrow services and title insurance. We work in tandem with a 1031 exchange company to ensure that the necessary documentation is completed to comply with the IRS requirements for a tax-deferred exchange.

Closing/Real Estate Document Preparation

We assist in preparing all the necessary legal documents for the transaction, such as deeds, tax documents, and closing statements. We work closely with all parties involved in the transaction, including buyers, sellers, real estate agents, and lenders, to ensure that all necessary documents are accurate, complete, and in compliance with all legal requirements. The document preparation process also involves verifying and recording all the necessary information related to the property, such as liens, judgments, and taxes, to ensure that the transaction is legally sound. This helps to minimize the risk of disputes and ensures a successful and stress-free closing process.
